Latin Legal Terms


Ratio – this Latin term has two different meanings:
1) It means reckoning, ruling on the point of Law.
2) It could also mean a manner, procedure, method.
The word participates in forming the legal term “ratio decidendi”, which literally is translated as “reason for the decision”. It is used in Court Trials, where state the main legal principle which led to the taken decision by the judge. The word participates also in the legal maxim “ratio est formalis cause consuetudinis”, which provides that reason is the base of custom or usage. The word participates also in the phrase “cessante ratione legis cessat ipsa lex”, which provides that a legal provision becomes invalidated when the reason for this provision has disappeared/ended.
