Latin Legal Terms


Communis – this Latin term means main, common, general. In the legal practice, the word relates to the legal term “just commune”, which describes the common aspects of the Civil Law (these underlying all aspects of the Law). A similar term is “Lex communis”, which means the same. The word also participates in the legal maxim “consuetudo ex certa causa rationabili usitata privat communem legem”, which provides for a custom, that has been established on certain and reasonable bases, to sustitute the provisions of the common law.
