Latin Legal Terms

Descriptio

Descriptio – literally this Latin noun means a description, an explanation, a piece of information, implemented in the text of a document; and individualization of something. In practice, the word is used in the legal term “description personae”, which means literally “a description of a person”. It applies in the area of Law of Contracts, where it is used to detail namely who are the parties to conclude an agreement, and implemented in the Preamble of the agreement. If the parties are individualized with their personal details, later they may not be able to claim they’ve never signed the contract, neither to free themselves of the obligations they have undertaken.
