Cognitio

Cognitio – this legal term has two different meanings, depending of where it has got application in the legal practice:
- is used in the area of Administrative Law, where refers to acknowledgment by charged person, for the issued fine. The role of acknowledgment is to start the deadlines for appealing the fine.
- Within the area of Court trials, it details the court hearing, examined and heard by the judge. Within this meaning, the word participates in the legal phrase “decree cognitionis causa”, which refers to a court order applicable in the Litigation Procedures. It is usually issued by court in cases where the creditor addresses the litigation against the heirs of the deceased debtor. The heirs then appear and renounce/refuse to accept the inheritance pot. In this way they refuse to turn into debtors, liable to the creditor.
